Description | Folios 277-279. Draft notes from the Poor Law Commission. They have been considering a letter of 22 May 1837 on the subject of obtaining orders of maintenance in cases of bastardy, and requesting the advice and assistance of the Commissioners. Referring to the notice, and by whom it should be signed; The Commissioners state that the effect of 4& 5 Wm IV c 76 s 72 'is to vest in the Guardians of a Union exclusively the power of making the application'. The [conditions] in this section provide for three cases. 1. Where a parish may remain under the provisions of the statute of Elizabeth. 2. Where a parish may be singly under a board of guardians appointed under the 39th section of the Poor Law Amendment Act or under Gilberts or any local act 3. Where the Parish may be in Union In the first case, the overseers of the parish would make the application, in the second case, the guardians of the parish, and in the third case the guardians of the union. 'The words Overseers or Guardians of the Parish, or the Guardians of the Union' all appear in order to meet all cases, not to imply that all or any of them may or must make the application, because this would be too confusing and it could lead to disputes as to who should make the application. When the board of guardians have decided to make the application, the notice required by section 72 should be signed by three guardians present and concurring.
