    Folio 229. [Draft letter from the Poor Law Commission to Henry Smith, Chairman of the Board of Guardians of the Basford Poor Law Union.] They have been considering the request made in the letter of 5 April 1837 that a discretionary power be given to the board of guardians of Basford Poor Law Union to enable them to relieve able bodied men with large families without sending them into the workhouse. The Commissioners emphasise that 'they feel no part of their duty to be more important or imperative than that of putting an end to all out door relief to the class of able bodied'. In consequence of the letter, the Commissioners have carried out an enquiry to find out the extent to which relief in the workhouse has been accepted by those able bodied men to whom it may have been offered. They find that on 1 April 1837 'the Basford W.H. (imperfect as the discipline exercised therein has latterly been) contains but six able bodied men'. The books show that the total number of inmates is currently 181, but in the previous week it was 183, and they feel this indicates 'that no great pressure exists upon the Basford W.H.' In the case of large families of young children, the Commissioners acknowledge that the burden on parents must be greater than where the families have few children, but they point out that parents are legally as well as naturally responsible for the support of their offspring. They say that it is only extreme cases 'that can justify the appropriation of the [common] fund of the community to their individual support'; that this is the principle of two Acts of Parliament; and that the Commissioners must adhere to this principle. They are not aware of any existing circumstances in the Basford Poor Law Union which indicates difficulty in adhering to the Rules as laid down for the guidance of the board of guardians.     Folios 365-366. Letter from the Reverend Henry Edward Knatchbull, vicar of North Elmham, to the Poor Law Commission, referring to their letter dated 25 August, [7893/A/1838] which was in answer to his dated 21 July in which he complained of the conduct of a relieving officer and of the board of guardians of Mitford and Launditch Poor Law Union not affording him any redress. He says that a month has now elapsed and he cannot ascertain that the promised enquiry by their assistant commissioner has been instigated into the wanton falsehoods which he believes have been propagated by the relieving officer in his parish. He presses this matter on their attention and trusts that they will take such steps as they think proper. Annotated: the Commissioners had been informed that the guardians had twice written to Mr Knatchbull requesting proof of the alleged misconduct and this has not been furnished so they have not deemed it necessary to direct their assistant commissioner to take any further steps at present. Draft letter from Poor Law Commission to [William Ashton, Clerk to the Guardians of the Basford Poor Law Union], in response to the recent Minutes of the Basford Poor Law Union board of guardians sent to the Poor Law Commission. Their comments are as follows; Relief to bastards. Mentions the 54 [section], classes of paupers. Also mentions 15 Section of the Poor Law Amendment Act and the rules and regulations for the administration of relief to the poor. Section 27 of the Act authorises justices to award relief to the old and infirm and by Section 54 to award temporary relief denied by the overseer and medical relief to paupers. A quote from the Act regarding justices powers. The Act allows the guardians to use their discretion in giving relief to a bastard child outside of the workhouse. Mentions statute papers with regard to a mother of a bastard child's duties and quotes the 18 Elizabeth [Act] and justices and churchwardens roles. They write of the decision in the case of Rex versus Haigh 3 GR [George Rex] 637, upon the 9 George 1 c 7 s 4, questioned and considered by, in particular, Mr Nolan. Letter from Samuel King, Clerk to the Guardians of the Mitford and Launditch Poor Law Union, to the Poor Law Commission, enclosing a copy of a letter and asking if the Commissioners consider it a proper and respectful letter. Enclosed letter from Henry Seales, Relieving Officer, Walsingham Poor Law Union. The letter states that he had been directed to inform the guardians of the Mitford and Launditch Poor Law Union that they had awarded an allowance of 3 shillings weekly to Mary Reid belonging to Fransham in the Mitford and Launditch Poor Law Union but living at Fakenham and to inform them that they will suspend any further payments after the ensuing week unless the amount of relief given to John Bangy, pauper (since deceased) belonging to Gateley and then residing in the parish of Ryburgh be immediately paid over to Seales and that they will in no case receive any application from any person connected with their union. They consider the treatment ungentlemanly and uncourteous as the man had applied to the relieving officer at Gateley and was referred to Seales as he resided in his district. He observes that they had not received such treatment from any other union. Annotated: Dr Kay [Dr James Phillips Kay], Assistant Poor Law Commissioner recommends that a copy of both letters be sent to the board of guardians of the Walsingham Poor Law Union. Annotated: draft letter to [John Ormsby] Clerk to Walsingham Poor Law Union, staying that the Commissioners feel that the board should be acquainted with the communications and expressing their regret that an officer should have ventured to endanger the harmonious intercourse which the interests of public service render most desirable between boards of guardians by writing a letter so coarsely and unaccountably offensive. They deprecate in the strongest manner the use of any such terms as are employed in remonstrating with any board of guardians concerning the course they may feel inclined to pursue. Letter from John Potter, Clerk to the Magistrates for the Hundred of Blything, Yoxford, to the Poor Law Commission, asking for a decision to be made on the following case in connection with the 57th Clause of the New Poor Act which has occurred in one of the parishes in his district: A women living in the parish of 'A' about three years ago had a bastard child by 'B' upon whom Order of Bastardy was made. Under this order 'B' paid the weekly sum agreed for maintenance of the child for about six months when he absconded to America and the bastard child consequently became a burden to the parish by 'A'. The woman has married since the passing of the late Poor Act. He asks whether the husband of the woman is liable to maintain the child as part of his family, or whether the parish of 'A' liable?     Folios 272-273. Letter from Stephen Clissold, Rector of Wrentham, to the Poor Law Commission, about the system of task labour for able-bodied labourers receiving parish relief. All such work should be written in an outdoor labour book, but efficient supervision is required, not by the relieving officer in agricultural districts, but by the overseers of the poor. Certificates can prevent fraud by the pauper or evasion by the parish, as the parochial officers are responsible for their truth. The adoption of this should not be pressed upon the parishes, they can send their paupers to the workhouse, and over-occupation will mean they take up the task labour system. Practically, the Blything Poor Law Union house is not yet ready for more inmates, and there are more able-bodied labourers. Their allowances are often equal to the independent labourer's wages, but they are indolent, and consequently discontented. There is already turbulence and considerable excitement when it became known that task work would be given in return for relief. He asks for some information on the subject, or improvements on the plan. The proposed plan will make it unnecessary for parishes to hire land. If digging the land is advantageous to the occupiers, so that there is competition to hire land [to the overseers], then perhaps the occupiers should pay the costs of ploughing. The usefulness of paupers signing or marking that they have received any payment is queried, they can rarely mark or sign their names, and it would be better to have the overseer or his representative to sign as a witness in the relieving officer's accounts. The use of the Receipt Book for bastard cases is also queried. In Blything Hundred the order is usually made payable by the magistrates to the board of guardians rather than to the churchwardens. The Board is awaiting the instructions of the Commission, but may object that these orders should be made payable to the churchwardens. Poor Law Union Number 432. Counties: Suffolk.
