Folios 191-195. Letter from Edward Senior, Assistant Poor Law Commissioner, to the Poor Law Commission, enclosing a copy of a letter from [N Sculthorpe] Clerk to the County Magistrates, and an extract from the Nottingham Review concerning the death of William Parkes [John Parkes]. Sculthorpe's letter says that Sandford Tatham Davison, Surgeon, and William Gill, Overseer for Stoke Bardolph, Basford Poor Law Union, appeared before Colonel Rolleston MP and Thomas Nixon, Magistrates, on [17 February 1841] to answer charges that they caused, or accelerated, the death of John Parkes, a pauper, by removing him from Gedling to the Basford Workhouse when he was in an unfit state and requiring medical attention. They are to appear before the next assizes to answer the charge. Sculthorpe also asks if the Poor Law Commission have authority to order the Basford Poor Law Union to pay legal expenses and expenses of the witnesses, the County Treasury not being liable in felony cases. Included is the cutting from the Nottingham Review reports the inquiry into the death of Parkes before Rolleston, Nixon, W B Martin and F Wright Parkes died from exhaustion and exposure, having inflammatory erysipelas. The jury considered that Davison and Gill were guilty of neglect and that Parkes did not receive sufficient care and diet when he reached the workhouse. The inquest was attended by C Swann, Coroner, and the following gave evidence: Mr Morley, Surgeon; Mr Robinson, Surgeon's apprentice; Mr Davison, Surgeon; Richard Salvin, Gill's servant; Robert Jerram, Guardian of Stoke; Mr Johnston, Governor of the Basford Workhouse; William Ashton, Clerk of the Basford Poor Law Union; William Maltby, pauper; Samuel Parkes, brother of the deceased. The evidence given concentrates on the move of Parkes to the workhouse and his treatment upon reaching there. Morley states that Parkes should not have been moved on such a cold day and that he would have given him spiced port wine but had no authority to do so without previous sanction from the guardians. This was confirmed by Johnston. Robinson had prescribed medicine for Parkes. After seeing Parkes on Friday Davison had directed that his parish be informed as he needed medical help. Salvin, on behalf of Gill, had asked Davison to see Parkes on the following Monday to determine if he could be moved to the workhouse. He was told that he, Davison, could not see him but that if Parkes was no worse he could be moved but he must be well wrapped up. Jerram had advised Gill to ask Davison's advice and, on seeing Parkes being put into a cart, thought Davison had given his permission for him to be moved. Ashton confirmed Davison's appointment as Surgeon for the Basford Poor Law Union at an annual salary of £30. Maltby saw Parkes in the workhouse and thought he was close to death. Parkes' brother, Samuel Parkes, sent his nephew to tell Gill that his brother was not fit to be moved but Gill refused to see him. Rolleston concluded that there was sufficient evidence to require Gill and Davison to answer charges at the next assizes and that the evidence showed that Parkes died because of lack of medical attention. Folios 5-11. Letter from Thomas Nixon, Magistrate, Visitor of the Poor House Basford, to Edwin Chadwick, Secretary to the Poor Law Commission, sending general answers to the queries sent to the 40 overseers, as follows: The 'Association' consists of 40 parishes, with a population of about 50,000, established about 20 years. A list of all 40 is included, with a copy of the 'Rules and Regulations'; They act in opposition to the 'Description of Persons' to be admitted, to give greater benefit to the united parishes; He has been a visitor to the house for about 5 years and one of his rules is to refuse relief out of the House to able-bodied male paupers; He quotes from the 43 Eliz c 2 s 1, as having harmed the Poor Laws; He and the other magistrates had received the letter dated 10 October [1834] and circular dated 6 October [1834] from the Poor Law Commission. He comments on improvements to the old system including settlements and appeals, saving expense and litigation; The improvement on the old Bastardy Laws; He states that Clause 72, however, is universally condemned. Refers to two Filiation Orders brought before the magistrates with comments from the senior counsel regarding witnesses, a brief to be prepared, fees in guineas, costs awarded to the defendants, the powers of magistrates within the Act, Overseer's responsibility to the defendant if failure to get the order. He mentions Clause 76, authorising attachment of wages and Section 59 as being unworkable as Masters will not subject themselves to the imposed liabilities; He suggests that as Clause 72 is unworkable, that in all bastardy cases, Filiation Orders be made at the Petty Sessions unless alleged father objects and has the means to pay to have it tried at the Quarter Sessions; He cites the case of a publican's son with no wages, goods or chattels and how Section 99 as in penalties and forfeitures, committal to prison is unworkable. He also regrets that apprenticeship, hiring and service are not included in Section 64. Mentions fraud and litigation in gaining a settlement of such cases; The Basford House was a model for the Southwell House under the direction of Mr Beeches. The house has a garden of 25 acres where produce grown is sold in Nottingham, 3 miles away. It also provides work for the able inmates. Stocking making has been given up in the house. Folios 263-268. Letter and report from H B Farnall,[Harry Bernard], Poor Law Inspector, to the Poor Law Board, regarding the Board's instruction to confer with the guardians of the Keighley Poor Law Union, concerning the communication received from Mr Ferrand [Bernard Farrand], ex officio Guardian. Mr Farrall reports that: On 28 September 1853 the guardians set up a special committee of ratepayers for each division of the Keighley Poor Law Union, to cooperate with a Sanitary Committee to carry out the regulations of the Board of Health. On 4 October a special meeting to consider the sanitary state of Bingley was convened by Ferrand, with Mr Ellis, also a county magistrate, at which two guardians attended. The meeting was distracted by a number of persons attending to be examined by the magistrate, so that it was not possible to transact any business. At the meeting of 28 September, the board of guardians resolved not to accept any report on nuisances submitted with charges or expenses to the union. The reports submitted by Mr Dryden and Mr Ainley, Medical Officers, at a subsequent board meeting were duly declined, with the board resolving that no additional medical officers be appointed or employed without the order of the board. A full inspection of the Bingley division has been carried out by John Dickson, union Medical Officer, and Aaron Bailey, Inspector of Nuisances, plus members of the committees, reports being submitted between 13 and 18 October. Inhabitants have readily agreed to any requests to remove nuisances, so that law proceeding are not needed. There has been some confusion about the rate of pay for their own medical officers, but no agreement had been made to pay £2 2s per day. The rate offered and accepted is £1 1s per day. There was some differences of opinion about Ferrand's attendance at the private meeting of the guardians, with the clerk giving assurance of Ferrand's right to attend as an ex officio member. Mr Farrall considers the enquiry to be complete, with the guardians acting legally and efficiently. The minutes of the various meetings described are included (paper A). Folio 302. Letter from George Spencer, Clerk to the Guardians of the Keighley Poor Law Union, to the Poor Law Board, explaining the reasons for recent increase in the numbers of paupers being relieved. Several reasons are proposed: Firstly, a large worsted manufacturer is dissolving, resulting in about 300 workers being unemployed, and likely to be so for several weeks, together with some workers only partially employed. Secondly, the inclement weather has resulted in frozen and snow covered ground, and also increases in prices of provisions. This has made it difficult for some to maintain themselves.
