Folio 134. Letter from Charles Bond, Clerk to the Guardians of the Axminster Poor Law Union, to E Chadwick [Edwin Chadwick], Secretary to the Poor Law Commission. Acknowledges receipt of letter dated 19 February [1846] and enclosed copy of letter from W North [of Ham, Stockland near Honiton]. North's letter is complaint regarding his entitlement to make coffin for pauper child who was recently deceased. The issues raised in North's letter have been brought before the board of guardians and the facts established were that the child survived a few hours from birth and after death occurred the parents of the child ordered a coffin, for which they paid 2s 6d, at their own expense. The order for the coffin was not given by Relieving Officer or any other parochial officer and the cost of coffin will not be paid from monies raised for the Relief of the Poor. Letter from George Spencer, Clerk to the Guardians of the Keighley Poor Law Union, to the Poor Law Board, acknowledging their letter of 15 May, 17970/1855, regarding the hiring of land on Harden Common for the employment of able bodied paupers. He encloses for approval the appointment form for Joseph Stell as Superintendant of Labour. The form shows Stell now of Cross Roads, Keighley, had been a 'Delver' and lately time keeper in a railway. Folios 259-261. Letter from Thomas Barnard to the Poor Law Commission, written at Beeston. At the suggestion of Mr Barnett of Nottingham, he forwards to Mr Gulson [Edward Gulson, Assistant Poor Law Commissioner] some observations written by himself on the Poor Law Amendment Act. He hopes they will be approved and circulated, as he wishes to promote its usefulness. Mr Fazakerly is in possession of one of the [pamphlets] which he will lay before the committee over which he presides. Attached is a printed pamphlet entitled 'Observations on the New Poor Law Bill, by Thomas Barnard, Beeston, near Nottingham.' In summary, it states that before the passing of the Poor Law Amendment Act most people felt the burden of rates was too great, and the burden was unequally spread over the country. He gives some statistics, and also believes it was too easy for the indolent to obtain assistance. He lists other failings of the old system. He then discusses the advantages that will arise from the new system for all sections of society, and says that those who oppose it do so through cupidity and ignorance. He refers to a speech of the late Mr Windham, Member of Parliament for Norwich [Norfolk], speaking 'in support of the last war'. He concludes that even with its imperfections, the new system will remove self interest amongst rich and poor, and tend to prevent oppression on one side and restlessness and discontent on the other. The pamphlet is printed by T P Youngman, Pelham Street, Nottingham. Annotated: to thank him for the pamphlet, which appears calculated to remove misconception on the operation of the Act. Folios 190-191. Letter from Charles Bond, Clerk to the Guardians of the Axminster Poor Law Union, to the Poor Law Commission. Mr Farmer, Guardian for the parish of Lyme Regis attended the Audit of the Parochial Accounts of this Union. Farmer complained that some items of allowances were disproportionate to sums allowed to other parishes. The Commission suggested that Farmer make a statement of the particulars in those cases and Farmer stated that there should be uniformity of allowances in all parishes of the union. Farmer's statement is as follows:- That the overseer for Lyme Regis charged 5s for each journey to Axminster to pay the contribution money to the Treasurer of the union (a distance of 5 miles) which charge was allowed by the Auditor. That the like charge was made and allowed for each journey by the overseers of Lyme to pay the County Rates to the Treasurer. That the overseers of Charmouth charged 3s for their journeys to Axminster for like purpose (distance 6 miles) and this was disallowed. Overseers of Uplyme charged 2s for each journey and this was disallowed. Overseers of other parishes charged the same rate (6d per mile) for journeys to the Treasurer and they were disallowed, except in the case of Lyme Regis who were allowed at the rate of 1s per mile. A charge made by Lyme Regis to convey paupers to the Union Workhouse (5 miles) varied from 12s to 8s 6d; whereas Seaton and Beer charged 6s 6d and the Auditor complained that this was too high a charge. Overseers of Charmouth had a regular charge of 3s 6d to convey paupers to the Workhouse (6 miles). The overseers of Lyme Regis charge too much for Expenses and for Carriage-hire in various other instances in their Accounts which were disallowed. Such charges being disproportionate to the sums allowed in similar cases to Overseers of other parishes in the union. Farmer adds that he considered the charges made by the overseers of Lyme Regis, and allowed by him, were over charges, and that vouchers ought to have been produced and suggests that uniformity in the allowances throughout the union. A Committee of Ratepayers was appointed to examine the accounts of the overseers of Lyme Regis prior to the Audit and that a minority of the Committee recommend the Accounts be passed, the minority did not include the Chairman. The Commission of Guardians wished this statement be forwarded to the Poor Law Commission and ask this be forwarded to Mr Tucker, Auditor for his remarks and explanations thereon. Folio 170. Draft letter from the Poor Law Commission to J and W Rees Mogg [John William Rees Mogg and William Rees Mogg], Clerks to the Guardians of the Clutton Poor Law Union, in response to their letter of 27 August 1839. They express regret that they must oppose the wishes of the board in the application of money from the sale of parish property. The Commissioners have often considered propositions to allow proceeds to remain in the hands of treasurers and have in every case recommended an investment in public funds. While recognising that the appointment of a broker would be attended by some risk the Commissioners recommend that a fresh power of attorney be given for each instance of selling. They consider that the proposal to borrow part of the sale price of Stowey and Farrington Gurney property to repay the sum advanced for building the new workhouse both complicated and inexpedient. The proportion due from each parish should be paid from proceeds of sale. Other parishes pay from current rates. Annotated: heavily by John George Shaw Lefevre. Folios 379A-397B. Letter from J Jolliffe [John Jolliffe], Medical Officer for the Axminster Poor Law Union to the Poor Law Commission from Chard [Somerset] regarding a recent case he had brought against the board of guardians of the Axminster Poor Law Union for a vote of censure against him. He asks about expenses not paid to a witness, James Fowler, and asks if Mr Bond has forwarded a bill from the coroner to himself for the depositions relative to the late Ann Clark's death, which Mr Graves, Assistant Poor Law Commissioner, said was necessary and for which he (Jolliffe) had paid £1 1s. He also asked why his expenses were not allowed and asks if the vote of censure recorded in the Minute Book of the Axminster Board should be erased. Annotated: notes for the reply. Folio 240. Draft letter from the Poor Law Commission to J Riley [John Riley], Auditor, Basford Poor Law Union. They acknowledge receipt of Riley's letter of 18 April 1837. They state that the book Number 9 which he referred to must be kept by the clerk [clerk to the board of guardians] as he suggested. Referring to the apprenticeships and indentures, the Commissioners wish to discourage the giving of premiums from the parish rates, as this practice is bad in principle and ought not to be adopted. They request that every case in which any premium may be proposed to be allowed may be reported to them by the clerk. The bill owed by the parish of Eastwood, if it has been allowed by the vestry, may be paid and allowed. However, the two bills for £2 1s 6d are being returned to Riley [not included] and they 'are totally inadmissible and must of course be disallowed'. The person who signed and authorised them must be charged with the amount. Riley is to explain to the board of guardians that no such payments can be permitted; 'that they are contrary to law and that the monies thus illegally paid is recoverable from the responsible parishes'. The Commissioners state that a separate order and a separate check for each particular payment should be given, and Riley must 'not pass any charge unless this cheque and the special order of the Board for such payment be produced'. Finally they stress that any relief given to able bodied paupers, either by the governor or other persons, contrary to the Rule prohibiting outdoor relief to the able bodied, must be disallowed. Anyone making such payment 'must be proceeded against & be held responsible for its repayment'. This should be fully explained to the Guardians, although the Assistant Poor Law Commissioner 'has already endeavoured to impress it upon them. Paper Number: 3298/C/1837. Poor Law Union Number 334. Folios 301-302. A notice to ratepayers requesting that they attend a vestry meeting at 12pm on the 1 June in the Parish of Colyton, to consider whether it would be appropriate to advance a sum of money to John Carter to assist with travel expenses for him and his family in emigrating to Canada. The notice is signed by William Skinner and Thomas Salter, Overseers. The notice has an addendum stating that the meeting ordered the overseers to pay the sum of £10 to John Carter, to be charged to the Poor Rate, to defray travel expenses.
